STATUS OF CHILD FROM EXTRAMARITAL PREGNANT MARRIAGES IN ISLAM
Comparative Study Between Positive Law Provisions and Shafi'i Mazhab

Married by Accident is a marriage that takes place when the bride is pregnant, and the child born later is called a child from Married by Accident. The status of children resulting from Married by Accident in positive law is regulated in Law No. 1 of 1974 and in the KHI. In addition to being regulated in positive law, the status of children resulting from Married by Accident is also regulated in the the Syafi’i Juridprudence which is the majority used by Indonesian society. This study was conducted to compare the child status of Married by Accident between the two. This research uses normative research methods on primary, secondary and tertiary legal materials. The results of this study indicate that the child status of Married by Accident is different between the provisions of positive law and Syafi’i Juridprudence. According to Positive Law, children resulting from Married by Accident are legal children, while according to the Syafi’i Juridprudence the status is as children resulting from adultery.
