PANDANGAN PENGHULU DALAM MENENTUKAN WALI NIKAH ANAK HASIL NIKAH HAMIL

Abstract

Girls born outside marriage when they wanted to get married in the Shafii’s school require a guardian of marriage. This research in KUA Jombang found that penghulu in the three districts of Jombang, Diwek and Peterongan different attitudes in determining guardian of marriage for women who were born as illegimate child. Both the pregnant mother married by men who impregnate or not a man who impregnated her. Differences in the views of the prince is based on differences in educational background of each person and the differences in understanding of the provisions of the UUP and KHI .
